CAMPTON — One person was indicted by the Grafton County Grand Jury for alleged financially exploiting an elder citizen, and stealing over $20,000.
Juli Fleck, 53, formerly of Campton, is indicted on two felony charges, Attorney General John Formella said on Tuesday afternoon.
The allegations in the indictments are only accusations, and Fleck is innocent unless proven guilty. She’s scheduled to be arraigned in Grafton County Court at 9 a.m. on Monday, Jan. 12.
The financial exploitation charge alleges Fleck, without legal authority to do so, took possession of financial resources belonging to her mother, described only as “M.F.” — who is an elderly adult — by making unauthorized purchases, payments or cash withdrawals from a bank account under circumstances where Fleck “consciously disregarded a substantial and unjustifiable risk” that M.F. lacked the capacity to consent.
The theft charge is an allegation Fleck obtained or exercised unauthorized control over property belonging to M.F., by making unauthorized purchases, payments or cash withdrawals from M.F.’s bank account, intending to deprive the victim.
In total, state prosecutors will argue Fleck took more than $20,000 from M.F. through those various means.
Each charge is a felony, punishable by 7.5 to 15 years at the New Hampshire State Prison, and a maximum fine of $4,000. The theft charge, additionally, alleges Fleck is subject to an enhanced penalty for taking advantage of M.F.'s age or a physical or mental condition that impaired M.F.’s ability to manage her financial resources. If the state proves it, the theft charge would be punishable by up to 10 to 30 years.
This matter was investigated by Det. Kristin Tracy of the Campton Police Department. The case is being prosecuted by Assistant Attorney General Nancy DeAngelis of the Attorney General’s Elder Abuse and Financial Exploitation Unit.
