Peter Dibiaso called me recently from the Belknap County Jail, where he is incarcerated. He urgently needs our assistance, as his situation is dire.
He informed me that he had been unjustly imprisoned for three years without a trial. This is not just a violation of the due process clause of the Sixth Amendment of the Constitution but a severe breach of justice. Such an unreasonable delay is an affront to justice. “The remedy for violating a defendant’s Sixth Amendment speedy trial right is dismissal of the charges with prejudice.”
Furthermore, he has had no attorney for the past three months, and the new superintendent of the jail has removed his legal documents from his cell and wants him to take a series of pills, which he refuses.
Officials also told him that he was psychologically unprepared to defend himself in court. If the state still refuses to provide him with an attorney, he should be able to protect himself.
