"50 USC Ch. 34: Sec 1621 NATIONAL EMERGENCIES (a) With respect to Acts of Congress authorizing the exercise, during the period of a national emergency, of any special or extraordinary power, the President is authorized to declare such national emergency."
The president should be given line-item veto authority for any federal legislation passed during a declared national emergency for any item not directly connected to the declared emergency.
The most recent $2 trillion, 883-page CARES Act – Coronavirus Aid, Relief, and Economic Security Act (H.R.748) contained many earmarks not related to the COVID-19 emergency, e.g., $25 million for the Kennedy Center; $75 million for PBS; $25 million for congressional salaries and expenses; $75 million for the Smithsonian; etc.
A national emergency crisis is NOT a time for Congress to pass pork.
