People are continuously spreading misinformation about our ability to deport illegal aliens. Some attempt to say the Aliens Enemy Act which Donald Trump has invoked must allow those being deported the right of habeas corpus and to have a judge rule. Those folks are off the mark. The real meaning in the act doesn’t give any judge the authority to decide on the deportation of non-citizens. However, if that alien were to, say, murder somebody here, and instead of deportation we wanted to keep them and try them for the crime, then a judge would come into play. Another untruth being peddled is that our 5th and 14th amendments are clear on this subject saying nobody can be deprived of life, liberty or property without due process in both amendments. They cherry pick a few words out of context and sell it like it is so written. What is missed is in the 14th Amendment which defines a citizen, “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.” The 5th states, “No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury ...” being an illegal alien doesn’t rise to the level of crime needed here. Finally, these folks keep saying that these “rights” are for everyone. Not the case. I give our citizens exhibit A. We the People, of The United States of America ... not the entire world, or any other country. The founding documents and all laws thereafter are for the citizens as defined in said document of the USA. Since many are incorrect, and still many others believe it, maybe this should be taught in our schools.
