A hearing in Concord District Court to determine whether Tom Emanuel is mentally competent to stand trial on many of the 63 outstanding criminal charges pending against him was continued yesterday when Justice Arthur Robbins, who was specially apppointed to hear the case, was taken ill.

Laconia attorney Peter Brunette, who represents Emanuel, said yesterday that when the next step in the case will be taken is unclear, not least because Robbins is slated to retire from the bench on Thursday.

Emanuel, 37, who has been diagnosed with bipolar disorder, has twice been found not competent to stand trial and in February 2004 was committed to the New Hampshire Hospital for five years, subject to conditional discharge. He was granted a discharge this summer, but has since been charged with more crimes.

According to Brunette, Emanuel is currently being held in the Secure Psychiatric Unit of the New Hampshire State Prison.
